TERMS AND CONDITIONS

 

1.       DELL AUSTRALIA PTY LIMITED ABN 46 033 855 561 of Building 3, Level 2, 14 Aquatic Drive, Frenchs Forest, NSW 2086 (“Promoter”), has engaged Professional Public Relations

ABN 16 001 045 450 of 118 Victoria Road, Rozelle NSW to run the “Alienware RTX Alienware Roccat Competition” (“Promotion”).

2.       Information on how to enter and prizes form part of these Terms and Conditions. Participation in the Promotion is deemed acceptance of these Terms and Conditions and the Promoter’s Privacy Policy.

3.       Entry is via the Internet only.

 

INTRODUCTION

4.       For the chance to win a combined Alienware and Roccat prize pack, Alienware fans are invited to articulate why they deserve a new Alienware and Roccat gaming set-up through a twitter post using the hashtag #AlienwareRoccat tagging @AlienwareOz and @ROCCAT. Those who submit an entry on the page, tagged with #AlienwareRoccat will automatically go in the running to win one of three prizes.

 

HOW TO ENTER

5.       To enter, individuals must, during the Promotional Period (as defined below), visit:

https://twitter.com/alienwareoz post within one tweet (140 characters) and state why they believe they deserve a new Alienware and Roccat gaming set-up, including #AlienwareRoccat tagging @AlienwareOz and @ROCCAT. Entries must be received by 11:59pm AEST on February 6, 2017. See below DATES section for prize draw and promotion dates.

DATES

6.       The Promotion commences at 9 am on  3/2/2017 and closes at 11.59pm AEST on 6/02/2017 ("Promotional Period").

7.       All valid entries received during the Promotional Period will be eligible to win one of the prizes outlined. See below PRIZES section for details of prizes

8.       To be eligible, participants must enter via Twitter using the hashtag #AlienwareRoccat tagging @AlienwareOz and @ROCCAT

9.       Entries only need to be submitted once to be eligible. Individuals may submit more than one entry, but each entry/tweet submitted must be different. Although multiple entries are permitted, each Participant can only win one prize.

10.    Participants found using multiple Twitter accounts to enter in this competition will be disqualified.

JUDGING

11.    The Promotion is skill based and chance plays no part in determining the winners.

12.    There will be two judges reviewing entries. Judging of entries will be based on the creative merit of the tweet in line with the promotional request.

13.    The two judges will review all entries and make a joint decision on which entry they believe should win each prize.

14.    The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant.

15.    Each winner will be notified by Twitter direct message and asked to share email and phone numbers so arrangements can be made for prizes.

16.    The prizes are as follows: to the approximate collective value of $3300AUD.

20.    Prizes, or any unused portion of the prize, are not transferable or exchangeable and cannot be taken as cash.

21.    Subject to the provisions of the unclaimed prize draw clause, if for any reason a winner does not claim  a prize by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

22.    If any part of the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal or greater value and/or specification, subject to any written directions from a regulatory authority.

23.    Prizes will be delivered to a single address nominated by the winners.

 

COST

24.    There is no entry fee for this competition.

25.    Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.

 

ENTRY CONDITIONS

26.    Entry is free and open to residents above the age of 18 from Australia only. Employees (and their immediate families) of the Promoter, PPR, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

27.    Incomplete or indecipherable entries will be deemed invalid.

28.    The Promoter accepts no responsibility for late, lost or misdirected entries or other communications.

29.    The use of Twitter is subject to all the terms and conditions of use of Twitter (which can be viewed here https://twitter.com/tos) and the Promoter reserves the right to remove any tweets in breach of these terms with immediate effect, at its sole discretion.

 

IDENTITY

30.    If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

 

COPYRIGHT AND CONTENT

31.    To the maximum extent permitted by law, the Promoter disclaims liability for any claims, suits, actions or damages arising from, or connected with, either directly or indirectly, the content submitted by entrants (“Content”). The Promoter may remove any Content, without notice, for any reason whatsoever.

32.     Entrants warrant and agree that:

a.       they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem:

                                                               i.      in breach of any intellectual property, privacy, publicity or other rights;

                                                              ii.      defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, sexual; orientation, religion, origin or gender; or

                                                            iii.      unsuitable for children aged under 15, or otherwise unsuitable for publication;

b.       they have obtained prior consent to reference any individual or material mentioned in the Content;

c.        they have obtained full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms set out here;

d.       the Content is free from viruses, and will not cause injury or harm to any person or entity; and

e.       they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.

33.    Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the warranties use out in clause 32 above.

 

CONDITIONS FOR DISQUALIFICATION

34.    If this promotion is interfered with in any way, or is not capable of being conducted as reasonably anticipated due to any reason, beyond the reasonable control of the Promoter, including but not limited to; technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as it deems appropriate.

 

CONSUMER GUARANTEES

35.    Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

 

LIABILITY

36.    Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.

 

PERSONAL INFORMATION

37.    The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to; agents, contractors, service providers and prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for a reasonable period, unless otherwise advised, use the information for promotional, marketing publicity, research and profiling purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.

AUSTRALIAN LAW COMPLIANCE

39.    The laws of Australia apply to this promotion to the exclusion of any other law.  Entrants submit to the exclusive jurisdiction of the courts of Australia.

40.    For the avoidance of doubt the Competition is managed and run by PPR.
